Personal Injury – Fatal Accident Case Study

A widow whose husband had been killed in a motor accident collision instructed us to claim damages for herself and her young children. Their financial dependency under the Fatal Accident Act 1976 largely depended on the husband’s future earnings, if the accident hadn‘t occurred, but because he had just set up his own business, this was difficult to estimate. A wheel came off a vehicle travelling in the opposite direction to our client’s vehicle causing it to lose control and collide with our client’s vehicle and to kill our client. We recovered £250k in damages for his widow and other dependants.
