Most separation and divorce cases are dealt with by negotiation between the clients and their lawyers and the Court is then asked to deal with things on a paperwork basis without the need for anyone to attend Court. If attendances are needed, then we can arrange representation for you to ensure that you feel as comfortable as possible in what are often emotional circumstances and to reassure you that your interests are being protected.

Is there a way I can work with my former partner to achieve a fair outcome without going to Court?

Have you thought about family mediation or Collaborative Law? These are ways of resolving disputes without formally involving the Courts, you remain in control of the process and the decisions are made by the two of you, taking into account things that are important to your family.

In family mediation, a mediator will work with you both to explore the options available and to help you find solutions to problems, or potential problems, and to reach agreements whether in respect of your children or your finances.

In collaborative law, you will each meet with your collaborative lawyer, agreeing not to go to Court, and will work through the issues together, again reaching agreements whether in respect of your children or your financial arrangements.

Is there anything else I ought to think about?

There are often so many practical and sometimes daunting things to think about on separation. Your Will, if you have one, and inheritance generally should be looked at to make sure your wishes are respected. Also, such things as joint bank accounts and whether it would be better for those to be closed or restricted.  If accounts are closed, ensure that arrangements are made for your regular bills and direct debits to be paid to avoid potential problems in the future.
