In a case that has taken 5 years of litigation, reports from an orthopaedic surgeon ,a prosthetic expert, a care expert, a housing expert and a motorcycling expert, conducting solicitor, David Dickie, recently helped a local biker win substantial damages at a high powered “joint settlement meeting” following lengthy court proceedings in the Derby County Court.
The rider was very seriously injured in a road traffic accident in 2009. He was riding his motorbike on his way to his holiday when he was hit by an overtaking vehicle traveling at high speed on the wrong side of the road. It was the fault of the driver of the overtaking car.
He lost his lower leg as a result of the incident and after many operations he was fitted with an artificial leg to help him to walk. He also suffered a serious fracture to his upper arm which left him with very severe limitation of function in the shoulder which is likely to be permanent. He struggles to use his arm following the incident despite medical help.
Timms Solicitor, David Dickie, along with a barrister, agreed on a settlement following negotiation.
In another case, Timms assisted a local cyclist to recover substantial damages following an accident in Derby in 2010 when he was catapulted off his bicycle after it had been struck from behind by a fast moving car traveling on the wrong side of the road.
Following the conviction of the driver for serious motoring offences, the claim was accepted by the driver of the car insurers. The life changing injuries suffered by the cyclist included a broken back, pelvis, ruptured spleen, nerve damage to his leg and head injuries, giving rise to an increased risk of epilepsy following a period of unconsciousness.
