Do I Need To Go To Court?

Our family lawyers know that resolving family disputes away from the Court can potentially save a great deal of time, money and stress. This can also help maintain the future relationship of the couple. This is especially important where there are children involved. Our family law team are members of Resolution and follow their approach to resolving family disputes.

Our family lawyers regularly recommend alternatives to Court, such as family mediation and collaborative law. They can also arrange for private hearings with an experienced retired Judge or specialist family law barrister to act as Judge to speed up the process of resolution and facilitating settlement, in appropriate cases.

We know, however, that avoiding Court is not always possible. People can have different ideas about what is fair or the best outcome and some may not wish to co-operate at all, whether it is to provide full information about their financial circumstances and obligations or to engage in negotiations. In those cases, the Family Court can be the only route to a fair and timely outcome.

If Court proceedings are required, we take a firm but fair approach to achieve the best outcome for our clients. We work with a wide range of experts, such as surveyors and valuers, accountants and tax and financial advisors and actuaries to ensure you have all the information needed to present the best case to the court, and as we know that costs are a concern, provide open and honest estimates of the costs that are likely to be incurred throughout your case.
