Personal Injury Claims - What Can I Claim For?

If you have suffered an accident through no fault of your own then you are entitled to claim for injuries (physical and psychological) directly relating to the accident. You are also entitled to claim for losses and expenses incurred as a direct result of the accident.

The physical and psychological injuries must be supported by medical evidence. This means that a medical expert must confirm, within a medico-legal report, that the injuries were either caused or exacerbated by the accident. Providing that the expert reaches that conclusion, compensation can be sought for the injury and affect it has had on your life.

Any losses and expenses also have to be supported by evidence and you will, therefore, need to prove that the loss or expense was incurred and that it was directly caused by the accident as opposed to unrelated factors.

We require the following evidence to prove this head of loss:

  • Loss of earnings – letter from your employer or 13 weeks of old wage slips, plus the slip showing your absence
  • Items damaged in the accident – original purchase receipts or estimates for replacement
  • Travelling expenses – copies of ticket receipts or a list of appointments attended including dates and mileage
  • Prescription or over the counter remedies – receipts from the chemist or shop
  • Care costs if a family member has had to look after you – a detailed list of hours and dates and who the provided the care

Depending on the extent of your injuries you may also be able to claim for things such as: cost of a professional care assistant, accommodation costs, cost of any future treatment or rehabilitation needs and cost of aides and equipment to aid rehabilitation
