Fatal Accident Claims
The untimely death of a loved one is a distressing situation and probably the most difficult experience anyone has to deal with in their lifetime.
Providing the highest level of legal representation, our specialist team deal with bereaved family and dependents in a sensitive and approachable manner and have successfully brought many high value fatal accident claims, whether arising out of work, road or other types of accidents. We understand that the avoidable death of a loved one can be difficult to cope with both emotionally and financially.
We appreciate that compensation won’t replace a loved one and we use our skills and professionalism to work quickly and compassionately during this difficult time, understanding that each circumstance is unique.
Under the Fatal Accidents Act 1976 the loss to the dependants of the earnings the deceased would have earned, or the services he/she would have provided in the future, such as DIY, childcare or housework can be compensated by a substantial dependency award. A separate award is a bereavement allowance for the deceased’s spouse or the parents of deceased children.
Funeral costs can be recovered under the Law Reform Act 1934, as can the cost of the deceased’s care and/or the deceased’s lost earnings prior to death, together with compensation for the pain and suffering of the deceased from the date of the accident up until the date of his/her death.
