Wills & Probate

Our friendly and knowledgeable Wills and Probate team have almost 70 years combined experience guiding and advising clients on Wills, Probate, Estate Administration, Intestacy, Deeds of Variation, Care of the Elderly, Lasting Powers of Attorney, Court of Protection/Deputyship Orders and Trusts.

With four offices in Burton Upon Trent, Derby, Swadlincote and Ashby de la Zouch, we aim to provide an excellent service in every area of expertise. We can also organise home visits too if getting into the office is difficult.

Five members of our team are trained as Dementia Champions and our support staff are all Dementia Friends. This means that the team have been trained to support clients who are living with dementia. We regularly host Dementia Friends Information Sessions which aim to give people an understanding of Dementia and the small things they can do that could make a difference.

In addition, five members of our team are Fully Accredited Members of Solicitors for the Elderly. We also have one full member of STEP and another two members of the team currently undertaking training.

Individually Tailored

We tailor our work to meet your individual requirements and have a professional, yet approachable, team of qualified Solicitors and Legal Executives with an experienced team of support staff.

Each year we draft thousands of Wills, giving clients peace of mind that their financial affairs are in order when they pass away. We use our knowledge and skills to prepare bespoke Wills that accurately reflect each individual client’s wishes. We are also particularly skilled in preparing Wills to minimise inheritance tax and Wills to protect assets from the effects of long-term care or re-marriage.

We also draft hundreds of Powers of Attorney enabling clients to appoint a representative to make decisions for them in relation to property and finances and health and welfare in the event that they become unable to make decisions themselves. The need for a Power of Attorney was particularly apparent during the pandemic when many vulnerable clients were forced to self-isolate.

For those who have not made a Power of Attorney, our team are able to assist your loved ones with a Court of Protection application for a Deputyship Order. This can often be a long and difficult process, but we are on hand to provide support each step of the way.

Our team are particularly supportive following the death of a loved one and are on hand to offer practical yet sympathetic advice. We can assist with as much or as little of the estate administration process as is required and are experienced in dealing with complexities which can often arise.

You’ll find everyone in our team shares Timms passion for providing outstanding levels of client care in a warm, friendly and approachable manner and are always on hand to answer any questions you may have.

  • Having met Charlotte, at the Dementia Friends session at Ashby Library, I can assure you that her interaction with my Mother in Law was excellent. For anyone dealing with these difficult issues around power of attorney and Wills, she definitely practices what she preaches. Thank you very much Charlotte for being so patient, kind and considerate.
  • Keith Baldock-Grimes was extremely helpful in all aspects regarding the Will of my late Mother. His kindness and understanding during this awful time has been a blessing.
  • I would just like to say that Sara Hilliard has been lovely to work with. She first came in to our lives when she visited my husband and I at home for us to make new Wills. My husband was very ill at the time. Since he has dies, I have been able to see her several times at her office and she has always been bubbly and very kind and pleasant to me.
